House Rules
Effective February 20, 2002
The primary purpose of these House Rules is to protect all occupants from annoyance and nuisance caused by improper use of the condominium apartments and also protect the reputation and desirability thereof by providing maximum enjoyment of the premises. The House Rules may be amended by the Board of Directors of the Association of Apartment Owners.
Condominium living may involve some curtailment of an individual's action due to the close proximity of other residents and the community use of various common elements such as the lobby, elevator, hallways and parking area. In general, common sense and consideration for your fellow residents should govern your actions. In any question over the meaning or intent of terminology herein, the decision of the Board shall be final.
These House Rules apply to all residents (owners, tenants and guests) and shall be administered and enforced by the Resident Manager with the assistance of the Managing Agent under the direction of the Board.
The Board shall not enforce any rule of the Association of Apartment Owners of Tradewinds Plaza which may be in violation of any statute, federal or state, or any Honolulu City and County ordinance.
OCCUPANCY
Registration. All occupants must be registered with the Resident Manager. The Manager shall be notified by the owner or the owner's agent of the names and duration of stay of any tenant before such tenant is allowed in any apartment. House guests for periods exceeding 5 days must also be registered with Resident Manager.
Number of Occupants. Occupancy is limited as follows: studio apartments with an area of 266 to 321 square feet no more than two persons; studio apartments with an area of 321 to 481 square feet no more than three persons; studio apartments with an area of 481 to 519 square feet and one bedroom apartments no more than four persons. (Reference: Housing Code of the City and County of Honolulu, Section 25-4.3b)
Use of Apartment. An apartment shall be used as a residence only. Commercial or business activities are prohibited. No persons, whether they may be owner, tenant, business agent, guest or licensee shall use the premises for any illegal purpose.
Pets. No birds, reptiles, cats, dogs, or other animals whatsoever shall be allowed or kept in any part of the project unless permitted by law.
Appointment of Local Agent. . "An absentee landlord shall designate an agent to act on the landlord's behalf. The agent must reside on the same island as the rental unit." (The Hawaii Revised Statues, Chapter 521, Landlord-Tenant Code - Section 43.D) Such owners shall file with the Resident Manager their out-of-town address and telephone number and the local address and telephone number of their agent. This agent being the representative of the owner shall be responsible for the renting, the conduct of the tenants and/or guests and the contents of said apartment.
No lessee, tenant, or guest may sub-lease an apartment without written permission of the owner or owner's agent.
Owners and/or agents for the owners shall notify the Resident Manager when their apartments will be unoccupied for more than one week.
No soliciting of goods, service or political or religious activities shall be permitted on the premises by a resident or other persons .
VIOLATIONS OF HOUSE RULES
Fines up to $100 per day, may be imposed for each violation, for each day a violation continues.
An apartment owner shall be responsible for the conduct of his lessees, tenants and guests and shall, upon request of the Board of Directors or the Managing Agent, immediately abate and remove, at his expense, any structure, thing or condition that may exist with respect to the occupancy of his apartment by his lessees, tenants or guests contrary to the interest and meaning of the provisions hereof; or, if the apartment owner is unable to control the conduct of the lessees, tenants or guests to conform with the interest and meaning of the provision hereof, he shall, upon request of the Board of Directors or the Managing Agent, immediately remove such lessees, tenants or guests from the premises, without compensation for lost rentals or any other damage resulting therefrom.
All corrective actions regarding violations of these House Rules and damage to the common elements or common areas will be enforced by the Board of Directors or the Managing Agent and all such violations and damages should be reported promptly to the Board of Directors or the Managing Agent.
Damages to common elements or common areas shall be surveyed by the Board of Directors or the Managing Agent and the cost of repair or replacement and any legal fees incurred may be assessed by the Board of Directors or the Managing Agent against the person or persons responsible, including, but not limited to, owners or occupants, for damages caused directly or indirectly by their guests.
GENERAL
It is the owner's responsibility to ensure that persons occupying their apartments receive and review a copy of these House Rules and abide by them.
24 hour advance notice must be given to the Resident Manager when household goods or large items of furniture are to be moved or delivered. All move ins and move outs shall be done through the basement level. All equipment such as carpet cleaning machines and all construction materials shall enter through basement level. Any damage caused by the moving of furniture or other personal effects shall be repaired at the expense of the resident/owner causing such damage.
For owners or their agents holding OPEN HOUSE for apartment sales, one OPEN HOUSE sign shall be permitted.
Foot Shower. Located just inside gate at the basement level. Wash sand off your feet and shake the sand off boards, beach mats, shoes, etc. before entering the elevator or lobby level.
Cigarettes or other items shall not be thrown from windows or lanais of apartments.
Fireworks anywhere on the building grounds or within the building is expressly prohibited.
Smoking shall be prohibited in all enclosed or partially enclosed areas within multi-family dwellings that are open to the common use by all unit owners or residents, including but not limited to lobbies, hallways, stairways, elevators, waiting areas and recreation areas. (Section 41-21.2 Revised Ordinances of Honolulu, 1990).
Anyone found vandalizing, tampering and/or defacing Association property will be subject to criminal charges and be liable for all costs involved in repairs, replacements or damages caused to the building or personal property.
No flammable oils or fluids such as gasoline, kerosene, naphtha or benzine, other explosives or other articles deemed extra hazardous to life, limb or property shall be brought into the building.
No apartment owner shall permit anything to be done or kept in an apartment or elsewhere on the project which will interfere with or unreasonably disturb the rights of other owners and/or occupants or reduce the value of the project.
No apartment shall be kept or maintained so as to permit or to attract any nuisance.
Upon request of the Board, an owner shall eliminate any nuisance and prevent its reoccurrence.
Garbage, rubbish and other trash shall be disposed of only in the basement trash bin. Trash shall be securely wrapped and tied in plastic bags before being placed in the trash bin. Disposal of bulky items such as mattresses, appliances, furniture, lumber, air conditioners, and auto parts is the responsibility of individual owners.
Waterbeds. No waterbeds shall be permitted in the apartments.
Maintenance employees of the Association are under the sole direction of the Resident Manager. During the prescribed hours of work they shall not be diverted to the private business or employment of any resident.
Water leaks in apartments shall be repaired immediately so water won’t be wasted or damage done to common elements or adjacent apartments.
Fans and air conditioners shall be turned off when apartment is vacant .
Plants maintained in resident apartments and lanai shall be pest free. The AOAO has the right to inspect all plants, pots, & soil for pests; in the event pests are noted, the AOAO will require pest treatment or plant removal. (Approved by BOD 09/18/07)
COMMON AREAS, ENTRANCES AND LANAIS
Barbecuing. No fires or barbecuing will be permitted anywhere in the building, expressly including lanais.
Birds and Pigeons. There shall be no feeding of birds either on the lanais or any common element.
Bicycles. Bicycles shall not be permitted in the elevator or stairwells of the building. They must be stored in the basement on racks provided. Storage is provided for Tradewinds Plaza residents only. Bicycles need to be registered with the resident manager. Bicycles cannot be parked in the walkways, driveways or upper parking stalls
Lanais - Care and Maintenance. An apartment owner shall be responsible for the care and maintenance of the apartment lanais. Such owner may not, however, paint or otherwise decorate the walls, floor or ceiling of the lanais without the prior written approval by the Board of Directors. This includes the installation of carpeting or tile on lanais.

Lanais - Furniture, Plants, etc. Only appropriate furniture and small plants shall be used on lanais. Any unsightly or disturbing items shall be removed upon the request of the Resident Manager. Items shall not be attached to the railings, walls or ceilings of lanai. Lanais are not to be used for storage purposes of any kind. Appropriate banners commemorating holidays or festivals may be displayed from lanais only on holidays except that reasonable Christmas decorations may be displayed during the month of December and the first week of January.
No items including clothes, towels, etc., shall be hung on lanais or on or from lanai railings for any purpose whatsoever. Clothing or laundry shall not be hung in doorways or windows in such a manner as to be in view of persons outside of the building.
The watering of plants, sweeping and mopping of lanais shall not create a nuisance or hazard to persons residing in adjacent or lower apartments, to the exterior building walls or common areas. Containers shall be placed under all pots so as to avoid dripping of water.
Air Conditioners. Condensation from air conditioners is not permitted to drip on lower apartments and exterior building walls or to persons and/or property on the grounds of the premises.
Obstructions; Uses. The sidewalks, passages, lobbies, stairways and corridors must not be obstructed or used for any purpose other than to enter and exit the property.
Personal Property.. Personal Property shall not be left in the common elements of the building, with the exception of bicyles and surfboards which must be stored in the designated areas in the basement.
Recreational activities, including rollerblading, skating, skateboarding, scooters and bicycling, shall not be permitted in the corridors, lobby, stairways, elevator, parking area, or other common areas.
It is the State Law that all fire doors MUST remain closed and unobstructed at all times. (Uniform Fire Code 10.402C) NO EXCEPTIONS.
The littering of the common areas is prohibited. Spitting on common elements is prohibited.
Surfboards shall not be permitted in the elevator or stairwells of the building. Surfboards must be stored in the basement on racks provided. Storage is provided for Tradewinds Plaza residents only. Arrangements for board storage can be made with the resident manager. The first surfboard storage slot per apartment is free; refer to the current "Bicycle/surfboard storage policy" for the rental rates and duration’s for additional slots, if available.
Apartment entrance doors shall be uniform in style and color, as approved by the Board of Directors.
PARKING

Vehicles Registered
All motor vehicles, including those in the basement parking area, must be licensed, operable and bearing current registration and safety stickers.
All vehicles, including bicycles, motorcycles and mopeds, shall be registered with the Resident Manager.
Repair. No repairs of a motor vehicle, boat, surfboard or other equipment or storage of property shall be permitted in the parking stalls.
Oil, Grease, etc. Cars dripping oil, grease, water or any substance from engines, etc. are prohibited from parking on the premises until repairs have been made.

Lobby Level Parking.
Parking shall be on a first come, first serve basis. The residents of an apartment are permitted to park only one car on the lot. This car shall be owned or rented by the resident. Proof of ownership may be required.
All vehicles shall be properly parked between the lines in designated stalls. Backing into stalls is not permitted. No resident's car shall be parked in the same stall for more than 24 consecutive hours. All vehicles must leave the parking area every 72 hours.
Visitor Parking. Visitor parking is permitted weekdays only between the hours of 8:00 a.m. and 4:00 p.m. Only one visiting vehicle permitted on each occasion. No visitor parking is permitted on Saturdays, Sunday and Holidays. This also pertains to contractors, rental agents and absentee owners.

Basement Level Parking.
Owners of rented parking stalls must register their parking tenants with resident manager.
Cleaning of stall. Owners of basement parking stalls are responsible for the cleaning of oil, grease, from their stall.
Only automobiles, mopeds or motorcycles may be parked in stalls
The resident manager is responsible for tow-away from common areas. Owners of private stalls are responsible for towing a vehicle from their stall.
Violation. Violations of the above shall result in fines and/or loss of parking privileges. The Manager or Board Members may tow away without notice and at the owner's expense any vehicle parked in an unauthorized place or manner or in violation of these rules.
NOISE
Occupants will not make or allow noises that will cause a disturbance to occupants of other apartments.
Except for emergencies approved by the Resident Manager, no maintenance personnel shall be allowed to commence work in the apartments or the buildings before 8:00 a.m. and all such work must cease before 6:00 p.m.
BUILDING MODIFICATIONS
No structural changes of any type shall be permitted either inside or outside an apartment without prior written approval of the Board of Directors.
Only window coverings of a white or off-white color in good condition will be permitted, so that when viewed from the outside, the exterior of the building will present a uniform appearance.
Every apartment owner shall perform promptly all repair, maintenance and alteration work within his apartment, the omission of which would adversely affect any common element or any other apartment, and shall be responsible for all loss and damage caused by his failure to do so.
All repairs of internal installation within each apartment such as water, light, power, sewage, telephone, air conditioning, sanitation, doors, windows and all other fixtures and accessories belonging to such apartment, including interior walls and partitions and the inner decorated or finished surface of the perimeter walls, floors, and ceiling of such apartment shall be at the apartment owner's expense.
No apartment owner or occupant, except with written permission by the Board, shall install any wiring or other device for electrical or telephone installations, television antenna, machines, or other equipment or appurtenances on the exterior of the building or protruding through the walls, windows or roof thereof.
Nothing shall be allowed, done, or kept in any apartment or common element which will overload or impair the floors, walls, or roofs of the building or cause any increase in the ordinary premium rates or the cancellation or invalidation of any insurance maintained by or for the Board with respect thereto, nor shall any noxious or offensive activity or nuisance be made or suffered thereon.
Washers and/or dryers not allowed in the individual apartments.
Windows may be tinted with the approved tint , as approved by the Board of Directors.
Lanai may be enclosed, as approved by the Board of Directors with proper building permit.
